Terms and Conditions A1 Retaining

1. 1. Services:
      A1 Retaining provides earthmoving, landscaping, and retaining wall services to clients according to their specifications. The company will carry out the work in a professional manner, using the necessary materials and equipment, and will ensure that the work meets the necessary standards and regulations. 
   2. Debt Collection:
      In the event that a client fails to pay for the services provided by A1 Retaining, the company reserves the right to engage the services of a debt collection agency, such as Marshel Freemen Debt Collection, to recover the outstanding amount. Any costs incurred in the process of debt collection will be added to the outstanding amount, and the client will be liable for payment. Failure to pay outstanding debts may also have an impact on the client's credit score. 
   3. Hitting Rock:
      In the event that rock is encountered during the excavation process, additional costs may be incurred by the client. The client will be notified of the additional costs and provided with a quote before work proceeds. 
   4. Unexpected Delays:
      A1 Retaining will make every effort to complete the work on time, however, unexpected delays may occur due to factors such as inclement weather, equipment breakdown, or unforeseen circumstances. In such cases, A1 Retaining will notify the client of the delay and provide an updated timeline for completion of the work. 
   5. Permits and Drawings:
      The responsibility of obtaining any necessary permits for the project is the sole responsibility of the customer, unless A1 Retaining agrees to take responsibility for obtaining the permits. Any drawings or designs created by A1 Retaining remain the property of A1 Retaining and may not be used or shared without prior written consent. 
   6. Materials Ownership:
      All materials used in the project remain the property of A1 Retaining until final payment has been cleared. The customer agrees to allow A1 Retaining access to the property to retrieve any materials owned by A1 Retaining, if necessary. 
   7. Deposit Payment Schedule:
      A1 Retaining requires a deposit payment of 30% of the total cost of the work prior to the commencement of the project. The deposit payment is non-refundable unless the client cancels the project within 48 hours of making the deposit. The remaining balance is due upon completion of the work. A1 Retaining reserves the right to halt work until full payment has been received. 
   8. Additional Charges:
      Any additional work required beyond the scope of the original agreement will be subject to additional charges, which will be agreed upon by both parties before work commences. 
   9. Liability:
      A1 Retaining will not be held liable for any damages or injuries that occur during the course of the project, unless they are a result of negligence on the part of A1 Retaining. The client is responsible for ensuring that their property is adequately insured. 
   10. Dispute Resolution:
       Any disputes that arise between A1 Retaining and the client will be resolved through negotiation and mediation. If a resolution cannot be reached, the matter may be referred to a court of law. 
   11. Termination of Agreement:
       A1 Retaining reserves the right to terminate the agreement if the client breaches any of the terms and conditions outlined in this document.

These additional terms and conditions are included to ensure that both A1 Retaining and the customer are clear on the responsibilities and obligations associated with the project. They should be reviewed and agreed upon by both parties before work commences.
